Shared intention normally leads to joint action. It does this, it is commonly said, only because it is a characteristically stable phenomenon, a phenomenon that tends to persist from the time it is formed until the time it is fulfilled. However, the issue of what the stability of shared intention comes down to remains largely undertheorized. My aim in this paper is to remedy this shortcoming. I argue that shared intention is a source of moral and epistemic reasons, that responsiveness (...) to such reasons on the part of each individual reinforces her own relevant attitudes, and that this enhances the stability of the shared intention as a whole. We thus discover an important self-reinforcing and stability-enhancing mechanism at the heart of shared intention and action. It follows from this proposal that the psychological commitment that an individual exhibits in joint action is normally a function not only of her own participatory intention, as often maintained, but also of her endorsement of the reasons created by her group’s shared intention to so act. The aim of this paper is to explore the peculiar case of infectious logics, a group of systems obtained generalizing the semantic behavior characteristic of the -fragment of the logics of nonsense, such as the ones due to Bochvar and Halldén, among others. Here, we extend these logics with classical negations, and we furthermore show that some of these extended systems can be properly regarded as logics of formal inconsistency and logics of formal undeterminedness.

In times of climate change and public debt, a concern for intergenerational justice should lead us to have a closer look at theories of intergenerational justice. It should also press us to provide institutional design proposals to change the decision-making world that surrounds us. This book provides an exhaustive overview of the most important institutional proposals as well as a systematic and theoretical discussion of their respective features and advantages. It focuses on institutional proposals aimed at taking the interests of (...) future generations more seriously, and does so from the perspective of applied political philosophy, being explicit about the underlying normative choices and the latest developments in the social sciences. It is widely held that there is a distinctive norm of assertion. A plausible idea is that there is an analogous, perhaps weaker, norm for indirect communication via implicatures. I argue against this type of proposal. My claim is that the norm of assertion is a social norm governing public updates to the conversational record. Off the record implicatures are not subject to social norms of this type. I grant that, as happens in general with intentional actions, off the record (...) communicative acts may be subject to normative assessments on different levels (for instance, regarding their moral or prudential appropriateness). However, such assessments do not generate distinctive norms that apply to all cases of implicature. (shrink)

In this paper I argue that some human reproductive genome editing interventions can be therapeutic in nature, and thus that it is false that all such interventions just create healthy individuals. I do this by showing that the conditions established by a therapy definition are met by certain reproductive genome editing interventions. I then defend this position against two objections: (a) reproductive genome editing interventions do not attain one of the two conditions for something to be a therapy, and (b) (...) some reproductive genome editing interventions are therapeutic but in a nonstandard way. In the Conclusion I call for a more nuanced discussion of the nature of reproductive genome editing interventions. (shrink)

Many conservatives endorse a defence of closed borders grounded in basic liberal rights such as the basic right of association. Some conservatives also endorse libertarian principles of legitimacy. It is not clear though that this sort of defence of closed borders is somehow coherent with these libertarian ideals. I argue that conservative libertarians of this kind must reject this defence of closed borders because either it collapses into a form of statism incoherent with libertarian principles of legitimacy, or into an (...) ideal precept without appeal regarding reality in the here and now that could only be applied to changing the very nature of the societies we know. As a result, at least conservative libertarians need to find a different source of justification for closed borders. (shrink)

Despite growing interest in workplace democracy, the question whether nonworker stakeholders, like suppliers and local communities, warrant inclusion in the governance of democratic companies, as workers do, has been largely neglected. We inspect this question by leaning on the boundary problem in democratic theory. We first argue that the question of who warrants inclusion in democratic workplaces is best addressed by examining why workplace democracy is warranted in the first place, and offer a twofold normative benchmark—addressing objectionable corporate power and (...) upholding efficiency—to assess the principles of democratic inclusion on offer. Against this benchmark, we next argue that the All-Affected Principle is unfit due to its over- and underinclusive extensional results, and that the All-Subjected Principle, whose variants we examine alongside their extensional results, holds more promise when coupled with independent considerations of justice or a constrained variant of the All-Affected Principle. These combinations need not entirely preclude, but speak against, nonworker stakeholder inclusion. (shrink)

En este trabajo examinamos el tópico de la responsabilidad en el derecho penal internacional a la luz de la filosofía de John Searle, y del fallo dictado por la Corte Penal Internacional en el caso de Thomas Lubanga. En el primer acápite analizamos la declaración de responsabilidad penal en función de la teoría de actos de habla de Austin y de Searle, tratándola como un acto ilocucionario cuyo significado es dependiente de un marco institucional específico. Luego, en el segundo acápite, (...) mostramos de qué forma tal marco puede reconstruirse como un ejemplo paradigmático de la realidad social construida descrita por Searle, especialmente en virtud del nexo entre mente, lenguaje y sociedad. A nuestro juicio, los conceptos de intencionalidad colectiva, atribución de funciones de estatus y poderes deónticos son fundamentales para entender tal nexo. En efecto, tal como argumentamos en la tercera sección, los sistemas de poderes deónticos asociados al derecho internacional no solo explican la aparición de Tribunales penales internacionales, como la Corte Penal Internacional, sino además el carácter imprescriptible de los crímenes de lesa humanidad. Los acuerdos internacionales que promueven y protegen los derechos humanos, y que tratan la imprescriptibilidad de aquellos crímenes, son objeto de análisis en la sección final, en donde exponemos algunas reflexiones finales a partir del caso Lubanga. For the philosopher of Rotterdam, religious coercion has two essential sources of illegitimacy: the linking of religious and ecclesiastical belief and the use of politics for religious purposes. Bayle responds to it, with his doctrine of freedom of conscience, on one hand and by means of the essential distinction between voluntary religious affiliation and political obligation, on the other hand. From my perspective, his doctrine of tolerance does not involve an atheist state, nor does it mean the rejection of the (...) presence of religion in the public space or its displacement to the intimate sphere of the conscience. This paper proposes a reading of Baylean tolerance as a political doctrine that allows the articulation between freedom of conscience, minority confessions, and official religion. Thus, the Baylean theoretical model could be considered a proposal to provide a normative form to the practice of toleration present in the seventeenth -century Netherlands. (shrink)

Nationalism seems a persistent ideology in academia as much as in politics; despite the fact that it has been shown that nationalism is deeply unjust for minorities. A case for national identity is often invoked to supplement liberalism regarding the inner difficulties that liberal theories have to explain their membership, assure stability and produce endorsement. So, it seems that national identity may also be required for justice. While this controversy continues, I argue that a different approach is available. We can (...) define a conception of legitimacy independently from a conception of justice, and then ask what legitimacy requires from our national allegiances. If everything goes well, much of the controversy from justice disappears as we find that the case for cultural nationalism may be illegitimate for liberal democracies. (shrink)

For most interpreters of the philosopher from Rotterdam, his political doctrine is solely a consequence of his religious and moral doctrines, and so an image of Bayle as a political philosopher is not usually presented. To my mind, however, only by analyzing his political doctrine can the extent of his religious proposal be understood. In this article, I intend to show that both the Baylean criticism of popular sovereignty and his rejection of the right of resistance are analyses that are (...) indissociable from the Baylean doctrine of tolerance. The protection of individual freedom of conscience and the defense of a multi-confessional state model, tolerant regarding religious minorities, can only be articulated as historical reality if they rest on the political doctrine of indivisible sovereignty and on the strictest separation between political obedience and religious membership. In this article, we will analyze the redefinition that Hobbes applies to the essential elements of Protestant biblical hermeneutics in the Leviathan. Establishing who is the authorized interpreter, defining the rules for conducting a proper exegesis, and determining the content that results from both tasks, is of utmost importance. The answers to these three questions lay the foundation for a new relationship between civil and ecclesiastical power and fully immerse Hobbes in the theological-political discussion of the 17th century.

Seen from the point of view of evaluation conditions, a usual way to obtain a connexive logic is to take a well-known negation, for example, Boolean negation or de Morgan negation, and then assign special properties to the conditional to validate Aristotle’s and Boethius’ Theses. Nonetheless, another theoretical possibility is to have the extensional or the material conditional and then assign special properties to the negation to validate the theses. In this paper we examine that possibility, not sufficiently explored in (...) the connexive literature yet.We offer a characterization of connexive negation disentangled from the cancellation account of negation, a previous attempt to define connexivity on top of a distinctive negation. We also discuss an ancient view on connexive logics, according to which a valid implication is one where the negation of the consequent is incompatible with the antecedent, and discuss the role of our idea of connexive negation for this kind of view. En este trabajo presentamos los fundamentos teóricos de una propuesta para el abordaje didáctico de concepciones teleológicas de los y las estudiantes en la enseñanza de la Biología. La propuesta en cuestión supone acudir al modo en que Darwin lidió con las concepciones teleológicas dominantes entre sus contemporáneos, para proponer una estrategia general a través de la cual se podría incidir sobre las intuiciones teleológicas de los estudiantes, de modo que se pueda facilitar el aprendizaje de la teoría de la (...) selección natural. Sugeriremos también que esta propuesta implica un modo original de apelar a la analogía entre el cambio teórico en la Historia de la Ciencia y el aprendizaje de las ciencias. (shrink)

Textos sobre la Espana Negra y sobre la corrupcion actual.

Este trabajo examina si la pregunta “¿puede pensar una máquina?” ha sido respondida de manera satisfactoria. La primera sección, justamente, examina el dictum cartesiano según el cual una máquina no puede pensar en principio. La segunda trata sobre una rebelión en contra de Descartes, encabezada por Babbage. A su vez, la tercera describe una segunda rebelión encabezada por Turing. En ambas se examina, primero el lenguaje mentalista/instrumentalista para describir a una máquina programada y segundo, el reemplazo de la pregunta por (...) el Juego de la Imitación. En la cuarta sección sostengo que la evidencia aportada por dicho juego nos devuelve a la pregunta, pese a Turing. Por último, la quinta sección versa sobre cómo la Habitación China de Searle, paradójicamente, apoya el dictum cartesiano, y lo hace porque tal experimento mental se basa en una capacidad mental falible: la introspección. Se concluye que la pregunta acerca de si puede pensar una máquina es derivada de otra pregunta filosófica compleja: la de la naturaleza de lo mental y el problema mente-cuerpo. (shrink)

According to John Searle, default positions, i.e., those intelligibility and action presuppositions, are some departing points from which pre-reflective and pragmatic assumptions are made. Postulating such points helps us deal with certain perennial philosophical issues, by leaving them aside. These problems are the existence of the external world, truth and facts, “direct” perception, the meaning of words, and causality. In this article, we argue that those default positions described by Searle constitute a default humanity, and their absence would dehumanize us. (...) Recent breakthroughs in stem cell differentiation and reprogramming suggest that functional human gametes could soon be created in vitro. While the ethical debate on the uses of in vitro generated gametes (IVG) was originally constrained by the fact that they could be derived only from embryonic stem cell lines, the advent of somatic cell reprogramming, with the possibility to easily derive human induced pluripotent stem cells from any individual, affords now a major leap in the feasibility of IVG derivation and (...) in the scope of their potential applications. In this paper we develop an ethical framework, rooted in recent scientific evidence, to support a robust experimental pipeline that could enable the first-in-human use of IVG. We then apply this framework to the following objectives: (1) a clarification of the genetic parenting options afforded by IVG, along with their ethical underpinnings; (2) a defence of the use of IVG to remedy infertility, broadening their scope to same-sex couples; (3) an assessment of the most far-reaching implications of IVG for multiplex parenting. These include, first, the liberation of parenting roles from the constraints of biological generations in vivo, allowing multiple individuals to engage in genetic parenting together, thus blurring the distinction between biological and social generations. Second, we discuss the conflation of IVG with sequencing technology and its implications for the possibility that prospective parents may choose among a hitherto unprecedented number of potential children. In view of these perspectives, we argue that, contrary to the exhausted paradigm according to which society lags behind science, IVG may represent instead a salient and most visible instance where biotechnological ingenuity could be used in pursuit of social experimentation. In this article, I discuss the Protestant contribution to the modern concept of autonomy on the basis of an analysis of John Calvin's moral theology. I show that Calvin affirms our incapacity to know and want what is morally good, as expressed by natural law. Such incapacity is compensated for by the biblical mandates that, according to Calvin, should be incorporated into the positive legislation of Christian republics. In view of all this, I conclude that Calvin is far from the (...) Kantian idea of autonomy which defines our Modernity. (shrink)

While the Academic sceptics followed the plausible as a criterion of truth and guided their practice by a doxastic norm, so thinking that agential performances are actions for which the agent assumes responsibility, the Pyrrhonists did not accept rational belief-management, dispensing with judgment in empirical matters. In this sense, the Pyrrhonian Sceptic described himself as not acting in any robust sense of the notion, or as ‘acting’ out of sub-personal and social mechanisms. The important point is that the Pyrrhonian advocacy (...) of a minimal conception of ‘belief’ was motivated by ethical concerns: avoiding any sort of commitment, he attempted to preserve his peace of mind. In this article, I argue for a Cartesian model of rational guidance that, in line with some current versions of an agential virtue epistemology, does involve judgment and risk, and thus which is true both to our rational constitution and to our finite and fallible nature. Insofar as epistemic humility is a virtue of rational agents that recognise the limits of their judgments, Pyrrhonian scepticism, and a fortiori any variety of naturalism, is unable to accommodate this virtue. This means that, in contrast to the Cartesian model, the Pyrrhonist does not provide a satisfactory answer to the problem of cognitive disintegration. The Pyrrhonist thus becomes a social rebel, one that violates the norm of serious personal assent that enables the flourishing of a collaborative and social species which depends on agents that, however fallible, are accountable for their actions and judgments. News about the first baby born after a mitochondrial replacement technique (MRT; specifically maternal spindle transfer) broke on September 27, 2016 and, in a matter of hours, went global. Of special interest was the fact that the mitochondrial replacement procedure happened in Mexico. One of the scientists behind this world first was quoted as having said that he and his team went to Mexico to carry out the procedure because, in Mexico, there are no rules. In this paper, we explore (...) Mexico's rule of law in relation to mitochondrial replacement techniques and show that, in fact, certain instances of MRTs are prohibited at the federal level and others are prohibited at the state level. According to our interpretation of the law, the scientists behind this first successful MRT procedure broke federal regulations regarding assisted fertilization research. (shrink)

These are some of the characteristics of La Boétie's doctrine that I believe place him within the tradition that Quentin Skinner calls the neo-Roman conception of civil liberty. Of course, La Boétie did not write a positive defence of the rule of law, as (...) Livy did in his History of Rome and as the English republicans do, but the Discourse can easily be read as a legal plea condemning absolute monarchy and any kind of arbitrary regime. (shrink)

La pregunta por la ética y la voluntad de vivir, frente a la racionalidad y la ecología utilitarista dan forma al texto de Enrique Leff. ¿Cómo se puede superar el estado actual de cosas sin recuperar una ética primigenia, la cual se hacía la pregunta por la buena vida, aquella que merece ser vivida? Siguiendo a Nietzsche, el rechazo por el sentimiento y las pulsiones están en el centro de la mirada racional e instrumental respecto de la naturaleza. La (...) búsqueda incesante del conocimiento objetivo nos ha llevado a olvidar las viejas preguntas acerca de cómo habitar el mundo; las mismas que la ilustración desechó en nombre del conocimiento científico y la dominación del mundo material. El artículo se concentra en indagar las diferentes declaraciones de Marx sobre la justicia, con la intención de determinar tres cuestiones: en primer lugar, saber si nuestro autor cuenta con una concepción de la justicia; en segundo lugar, establecer si la reflexión acerca de lo que es justo ocupa un lugar privilegiado en su obra; y, en tercer lugar, ver si a partir de ahí puede colegirse la existencia de una teoría marxiana de la justicia. It is usually assumed that political modernity and the reformation go hand in hand. Authors such as Hegel, Tocqueville, Jellinek or Martha Nussbaum find in the protestant reformation the origin of ideas such as political freedom or freedom of conscience. In this paper, I will try to analyze the relationship between these two concepts in two fundamental characters in the Calvinist tradition. John Calvin, its founding father, on the one hand, and, on the other, Pierre Bayle, the Rotterdam philosopher who (...) pushed Calvinism to its most heterodox forms in the XVII century. I will show how they both understand the interpretation of the Bible and the political arrangements that they defended for their close context. (shrink)

The topic I address in this paper is whether the independence of Church and State brought about by the Lutheran Reformation tantamounted to the secularisation of the latter. Taking into account two recent essays by Harold Berman and John Witte on the Lutheran contribution to the Western legal tradition, I argue that Luther’s criticism of the catholic doctrine of Papal power came hand in hand with a theologization of the foundations of the authority of the State, which is difficult to (...) deem «secular». The ancient Ouroboros symbolism (one who eats oneself) is here integrated into a simple birth-death clustering process that needed nothing but itself for a transition from indistinguishable phases to a sort of higher level ”conscious” phases. Birth and death coefficients are formulated in terms of odd and even exponentials used to represent a suitable form for conscious states via the internal transfer of information. This toy model may ideally quantify conscious states having inner causes via an Ouroboros index 0 < (...) Υα,Ω < 1. The value Υα,Ω = 0 lends to infinite loops and the limiting values Υα,Ω → 1 disclose transformation into awareness. Relationships with physics theories of consciousness and the use of the Oroborous index to discern about conscious-like states in Artificial Intelligence systems are discussed. For most interpreters of the philosopher from Rotterdam, his doctrine of tolerance is solely a consequence of his religious and moral doctrines. In this article, I intend to show that his doctrine rest on the political doctrine of indivisible sovereignty and on the strictest separation between political obedience and religious membership. Baylean tolerance is a political doctrine that allows the articulation between freedom of conscience (individual), minority confessions (private associations), and public religion (acknowledged as official).

Pierre Bayle and the impossibility of a rational debate on evil I claim that Bayle engaged with theodicy in order to show how philosophy was misused in religious matters. For Bayle, the debate on evil does not oppose dichotomically reason and religion, it just requires that the participants deal with revealed truths using reason alone. In this regard, Bayle does not only criticize the Calvinist theologians of his time, but also the very source of Christian theology, Augustine of Hippo. En (...) ese artículo, sugerimos que el debate sobre la teodicea bayleana tiene por finalidad hacer patente el uso ilegítimo que se hace de la filosofía al aplicarla al debate religioso. La discusión sobre el mal no supone una disputa entre la razón en sentido absoluto y la religión, sino que compromete el uso de la razón en la revelación, de modo exclusivo Por esa razón, como veremos, el filósofo de Rotterdam no limita su crítica a la teología calvinista de su tiempo sino que la dirige al mismo corazón de la teología cristiana: la obra de Agustin de Hipona. Commentary on "Politics " of Aristotle , in Spanish.

Calvin was a man of the Church so his political doctrine stems from his ecclesiology, in response to both the Papal doctrine on the delegate power of the magistrates, and the Lutheran subordination of the Church to the civil authorities. He was not concerned with discussing the best possible regime, but rather with preparing a theological justification of civil power that would make it depend exclusively on God, not on the people. I will hold that Calvin states the people’s function (...) is merely instrumental: they accept the authority chosen by God, but do not institute it. The only really relevant element is that both political vocation and the transmission of power that is indispensable to it, derive uniquely and exclusively from God. The discrepancies apparent in different authors’ interpretations can be clarified by recovering the context of his argumentation. This is the objective of this article. (shrink)

This paper discusses the reach of ecclesiastical power in Hobbes' Leviathan, examining how the State acquires some of the roles traditionally played by the Church. I will first contextualize historically the ecclesiological debates on which Leviathan draws. Then, I will examine the essential role Hobbes assigns to the king in the governance of the church. Although Hobbes' political theology is often deemed atheist, in Leviathan the king becomes the institutional head of the Church. Moreover, he should establish a minimal Christian (...) creed to be shared by his subjects, in order to preserve religious peace among the different churches of his kingdom. (shrink)

In a recent publication Tom Douglas and Katrien Devolder have proposed a new account of genetic parenthood, building on the work of Heidi Mertes. Douglas and Devolder’s account aims to solve, among other things, the question of who are the genetic parents of an individual created through somatic cell nuclear transfer (i.e. cloning): (a) the nuclear DNA provider or (b) the progenitors of the nuclear DNA provider. Such a question cannot be answered by simply appealing to the folk account of (...) genetic parenthood, according to which the genetic parents of an individual are those individuals who produced the egg and sperm, respectively, which fused to create the embryo. It cannot be so as in cloning there is no fertilization as such. In this article I critically examine Douglas and Devolder’s new account of genetic parenthood and demonstrate that it is vulnerable to counterexamples that exploit the lack of a condition specifying that genetic parents should cause a child’s coming into existence. Several European countries are approving legislative reforms moving to a presumed consent system in order to increase organ donation rates. Nevertheless, irrespective of the consent system in force, family's decisional capacity probably causes a greater impact on such rates. In this contribution we have developed a systematic methodology in order to analyse and compare European organ procurement laws, and we clarify the weight given by each European law to relatives' decisional capacity over individual's preferences (expressed or not while alive) regarding (...) the destination of his or her organs after death. In this sense, the results constitute the first comprehensive and comparative legislative mapping on European transplantation laws. (shrink)

In this paper, we try to show that the existing Spanish secular model should be defined in terms of collaboration. Religious freedom is interpreted by Spanish judges in a Catholic framework, as an implementation of the Second Vatican Council's Declarations and Constitutions. In this sense, the Catholic Church has managed to impose its authority through privileged agreements with the Spanish State. _Keywords:_ religious freedom, secularism, Spain, religious law.

In Consciousness Studies it is common to distinguish between subjective character and qualitative character. It is also non unusual to maintain that both can be analyzed independently. This is called the “division of conceptual labor”. This idea, however, does not match with our intuitive insight that subjective character is multiple. Here I identify the idea of the division of conceptual labor as a version of the myth of the self, and I push forward two arguments against it. After that, I (...) will propose an alternative characterization of subjectivity on conscious experience. My main conclusion is that, in order to define the subjective character, we do need the qualitative character. The self needs the other. (shrink)

Doxasticism is the thesis that intention is or involves belief in the forthcoming action (Velleman, Harman). Supporters claim that it is only by accepting that thesis that we can explain a wide array of important phenomena, including the special knowledge we have of intentional action, the roles intention plays in facilitating coordination, and the norms of rationality for intention. Others argue that the thesis is subject to counterexample (Davidson, Bratman). Yet some others contend that the thesis can be reformulated in (...) a way that avoids such counterexamples and preserves its explanatory significance (Pears, Setiya). Their suggestion is that we view intention as involving partial –rather than full—belief. I argue that while the move from full to partial doxasticism helps to accommodate such counterexamples, it does so in a way that undermines the ability of the resulting view to explain the coordinating roles of and rationality norms for intention. Some recent researches in experimental philosophy have posed a problem for philosophers’ appeal to intuition (hereinafter referred to as PAI); the aim of this paper is to offer an answer to this challenge. The thesis against PAI implies that, given some experimental results, intuition does not seem to be a reliable epistemic source, and —more importantly— given the actual state of knowledge about its operation, we do not have sufficient resources to mitigate its errors and thus establish its reliability. That (...) is why PAI is hopeless. Throughout this paper I will defend my own conception of PAI, which I have called the Deliberative Conception, and consequently, I will defend intersubjective agreement as a means to mitigate PAI errors, offering empirical evidence from recent studies on the Argumentative Theory of Reason that favor the conception I defend here. Finally, I will reply to some objections that might arise against the Deliberative Conception, which will lead me to discuss some metaphilosophical issues that are significantly relevant for the future of the dispute about the appeal to intuition. In this paper, I will discuss what the first phases of the long history of the transformation of Political in the Spiritual patria consisted of and those who made the development possible. In this essay the main protagonists will be Cicero and Saint Augustine. We will see how St. Augustine could complete the transformation of Cicero's political ideal not only theoretically but practically. St. Augustine's great work can be understood to be a replica of Cicero's Republic in which the City (...) of God is made into the Dream of Scipio and the Church occupies the place of the res publica. The theologizing of the political concepts is taken from the modernization process which Schmitt defined as illegitimate politics of the process of secularization of theoretical concepts. (shrink)
